Internal Regulations
of the Social Promotion Association
"LA MALAGAZZETTA APS"
Approved by the Board of Directors pursuant to art. 9 and art. 17 of the Statute
These Internal Regulations implement the provisions of the Association's Statute, with particular reference to membership categories, associated benefits, member-only prices, the refund policy, and the management of the Association's commercial and recreational activities. These Regulations may be amended by the Board of Directors without requiring a statutory amendment, pursuant to art. 9 of the Statute.
TITLE I – MEMBERSHIP CATEGORIES AND BENEFITS
Art. 1 – Membership validity
All membership card categories are valid for 365 days from the date of enrollment or renewal, regardless of the calendar date on which payment is made.
The Board of Directors automatically updates the member's status from "Active" to "Expired" upon reaching 365 days, unless renewed. Renewal generates a new 365-day term starting from the payment date.
Art. 2 – Reader category
The annual membership fee for the Reader category is set at €5.00 (five euros).
The Reader member is entitled to: unlimited access to the digital copy (PDF) of all issues of "La Malagazzetta" magazine in the catalogue, both current and back issues; access to the members-only shop; the ability to purchase magazine issues in print format and merchandise at prices reserved for members compared to non-member public.
The Reader membership is non-refundable. The member may request cancellation at any time, without right to a refund of the fee paid.
Art. 3 – Collector category
The annual membership fee for the Collector category is set at €50.00 (fifty euros), unless otherwise determined by the Board of Directors.
The Collector member is entitled, in addition to the benefits provided for the Reader category, to: a print copy of all magazine issues published during the membership year, shipped to the address provided by the member; an exclusive metal miniature, produced in a limited edition and reserved solely for Collector members of the current year.
Print copies are sent as author's copies through the distribution channel used by the Association, with each magazine issue.
Art. 4 – Member-exclusive prices
Members in good standing with their membership are entitled to reserved pricing for the purchase of back issues of the magazine, in PDF and print format, and for merchandise available in the members-only shop.
Member-exclusive prices, distinct from the public list price, are determined and updated by the Board of Directors based on production and distribution costs, without requiring an amendment to these Regulations.
Non-member users do not have access to the members-only shop and are directed to public sales channels (e.g. third-party publishing distribution platforms) for purchasing the magazine in print format.
Art. 5 – Category upgrade
The member may request at any time during the membership year an upgrade from their current membership category to a higher category, by paying the difference between the fee already paid and that required for the new category.
Following the upgrade, the member receives the full benefits of the new category for the entire current membership year, including any back issues of the magazine already published during the year, without the need for a separate purchase.
The membership expiry date is not changed by the upgrade and remains the original one, calculated on the 365 days from the date of first enrollment or last renewal.
TITLE II – REFUND POLICY
Art. 7 – Membership fees and editorial subscriptions
Membership fees and the editorial benefits associated with each category are non-refundable under any circumstances, in accordance with the associative and non-commercial nature of the relationship between the member and the Association.
The member may request cancellation of their membership at any time, without right to a refund of the fee paid. Membership status ceases from the date of the cancellation request, without prejudice to effects already produced.
Art. 8 – Merchandise and physical products
Refunds or replacements are provided only in the following cases:
a) Merchandise products found to be defective or damaged upon receipt, provided the member reports it within 14 days of delivery;
b) Shipping errors attributable to the Association, such as delivery to an incorrect address due to the Association's fault or loss of the product during shipping;
c) Payment errors, such as duplicate charges or incorrect amounts, limited to the excess actually paid relative to what was due.
The refund or replacement request must be submitted to the Board of Directors through the Association's official contact channels, with attached photographic or payment documentation in support, where relevant.
The Board of Directors evaluates the request and decides, at its discretion and in accordance with the principles of good faith, whether to proceed with a refund, product replacement, or sending a new copy.
TITLE III – "MALAPIETRA" PROGRAM
Art. 9 – Purpose of the program
The Association adopts a gamification system called "Malapietra", inspired by the narrative setting of the recreational activities promoted, with the aim of making members' participation in the financial support of the associative project transparent and engaging.
The Malapietra program does not constitute in any way a currency, a credit instrument, a purchase voucher convertible into money, or a loyalty system with commercial value. It is exclusively a symbolic and narrative indicator of the associative contribution, devoid of any autonomous economic value or refundability.
Art. 10 – Accumulation mechanism
Every purchase of a membership, editorial subscription, back issue, or merchandise item generates an amount of Malapietra proportional to the net revenue actually achieved by the Association on that transaction, at a reference rate of 1 (one) euro of net revenue equal to 1 (one) unit of Malapietra, unless otherwise determined by the Board of Directors.
From the net revenue of each transaction, a fixed share is first deducted, determined by the Board of Directors, allocated to a fund dedicated to organizing events and reimbursing expenses incurred by volunteers. Malapietra is calculated on the remaining revenue share after this deduction.
The amount of Malapietra generated by each product or service category is determined by the Board of Directors and published in aggregate form on the Association's digital platform, without obligation to disclose margins or specific costs of each product.
Art. 11 – Objectives and use of Malapietra
The Board of Directors annually defines a Malapietra threshold corresponding to the coverage of the Association's fixed management costs, and a series of subsequent objectives whose achievement unlocks additional initiatives for the benefit of the associative community, such as supplementary editorial content, original gaming materials, or dedicated events.
The objectives unlockable through reaching Malapietra thresholds consist exclusively of collective benefits for the membership at large, and may in no case translate into distribution of profits, monetary refunds, or individual economic advantages in violation of the prohibition set forth in art. 1 and art. 22 of the Statute.
The progress of the Malapietra program is published on the Association's digital platform as a progress indicator, visible to both members and the general public, for transparency and promotion of the Association's activities.
TITLE IV – FINAL PROVISIONS
Art. 12 – Amendments to the Regulations
These Internal Regulations may be amended at any time by the Board of Directors, without the need to convene the Assembly or make a statutory amendment, subject to compliance with the principles and limits established by the Statute.
Amendments to the Regulations are communicated to members through the Association's official digital platform and take effect from the date of publication, unless otherwise indicated by the Board of Directors.
Art. 13 – Reference to the Statute
For all matters not expressly provided for in these Regulations, reference is made to the Association's Statute and the legislation in force regarding Third Sector Entities.
